Subject: Petition for Vacation of Office, by reason of Unethical Conduct, and Prohibited Acts.

Be here advised that Homer City Council members

 Aderhold, Lewis, Reynolds are each

here proven unfit for public office, as evident by their individual efforts in preparation of  Resolution 17-019  the text of  of which stands in  clear and obvious

Violation of Homer City Code, Title 1:

1.18.030 Standards and prohibited acts.

n. Political Activities – Limitations of Individuals. A City official may not take an active part in a political campaign or other political activity when on duty. Nothing herein shall be construed as preventing such officials from exercising their voting franchise, contributing to a campaign or candidate of their choice, or expressing their political views when not on duty or otherwise conspicuously representing the City.

 ..

As well as  flagrantly in  violation of Ethical Standards  Conduct in office, as described by  the   Alaska State  Constitution  Article 12, General Provisions:

§ 4. Disqualification for Disloyalty:

No person who advocates, or who aids or belongs to any party or organization or association which advocates, the overthrow by force or violence of the government of the United States or of the State shall be qualified to hold any public office of trust or profit under this constitution.

and:

§ 5. Oath of Office All public officers, before entering upon the duties of their offices, shall take and subscribe to the following oath or affirmation: "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the Constitution of the State of Alaska, and that I will faithfully discharge my duties as . . . to the best of my ability." The legislature may prescribe further oaths or affirmations.

.

Wheras the use of City Council office as a platform for broadcasting political activism is unlafwful, unethical, and outside the bounds of permissable conduct in public service..

For these breaches of civil conduct,  It is incumbent on continued peaceful discourse of the local  government that  the AUTHORS of this Resolution 17-019 tender immediate resignation of  Public offices held, and forthwith quit their residence in all bodies of Civil  Authority.

 .

  Submitted with due diligence,

 Dean Ravin.
